Summary:
As the crab fishery got closer, the claimant spent more time on the repairs to his ship. Umpire found that the claimant was self-employed in fishing and spending a considerable amount of time on the ship's repairs. Referring to Jouan (A-366-94) and Taschuk (A-616-95), the FCA reaffirmed the principle that preliminary steps taken by a claimant to start up a business are to be taken into account in determining whether the ss.43(2) exception applies.

Summary:
As per the Board, if a fisherman has gear in the water, he is deemed self-employed and is not entitled to UI. Based on the facts of this appeal, I cannot accept the proposition that the mere placement of nets in the water automatically means that claimant spends his entire day fishing. Minor in extent.

Summary:
Devoted full time to fishing from June to October. It is true there were periods when it was impossible to fish due to the weather but he was still pursuing as a fisherman. Full-time fishing during the season is a major form of employment in Newfoundland. 43(2) does not help him.
