As the crab fishery got closer, the claimant spent more time on the repairs to his ship. Umpire found that the claimant was self-employed in fishing and spending a considerable amount of time on the ship's repairs. Referring to Jouan (A-366-94) and Taschuk (A-616-95), the FCA reaffirmed the principle that preliminary steps taken by a claimant to start up a business are to be taken into account in determining whether the ss.43(2) exception applies.
