Summary:

The Board concluded that there had been a veritable break in the continuity of the claimant's employment and that she was entitled to benefits during the non-teaching periods from December 25, 2005 to January 7, 2006 and from March 5 to 11, 2006. While there may have been a 'veritable break' in the claimant's job continuity her contract had not been broken or terminated. The Board of Referees erred in law.

Summary:

Claimant on sick leave from 12-92 to 03-93 and Christmas vacation at issue. Umpire erred in stating that respondent could not be deemed to be bound by a teaching contract. The evidence showed that the contract had never been terminated. Services and pay simply suspended. Section 46.1 was therefore applicable.
