Summary:
Claimant admitted wanting to establish his law office and not look for other employment. According to the Umpire, section 30 of the EIA creates a presumption that, in the situations listed therein, a claimant is considered to have worked a full working week and it is the claimant's responsibility to disprove this presumption, which he failed to do. FCA summarily dismissed the claimant's application.

Summary:
Claimant disentitled as not available 4 days because he was licensed to sell real estate. CEIC submits this is just mere technicality since he was employed in real estate. I do not agree. That ground was chosen to disentitle him. Having a license does not mean non-availability.

Summary:
I limit duration of non-availability under 25(a) to a number of days less than one week. Accordingly, decision under Reg. 43 justifies disentitlement for full weeks only, while decisions under 25(a) may be for any additional day.
