Summary:
Unfortunately, carelessness is not a valid excuse for finding that a claimant did not "knowingly" make false statements in reportedly declaring no earnings for periods during which he must have been well aware that he had some, even if he did not at the time know the exact amount.

Summary:
No evidence that she reported these earnings on another reporting card. A claimant's mistake in wrongly reporting information requested, in circumstances where reasonable care would have avoided the error, is not a basis for concluding the act was not knowingly done.

Summary:
The first form was completed within days of his having quit the job briefly held in January and I can only conclude in light of his failure to take care to ensure that the form was completed accurately, that his carelessness was tantamount to knowingly making a false statement.

Summary:
It appears that he failed to declare his earnings because he was sloppy, also he was unaware that he had to report earnings falling in the waiting period. I am satisfied that clearly he knew what he was doing. An excuse of sloppiness is not an excuse.

Summary:
I can find no error in Board's decision. The discrepancies in claimant's reports of earnings were small, but frequent. The Board found that they indicated a lack of care and caution on claimant's part to avoid making false statements. The fine was reduced substantially.
