Summary:

The case involves an employer appeal against a Commission's decision that the claimant had just cause in voluntarily leaving employment. The employer argued that the absence of a recording of the proceedings before the BOR was prejudicial and requested as remedy a new hearing before a Board with all the appeal rights flowing therefrom. The Umpire gave the employer every opportunity to present her case orally including oral presentation by any witnesses if she so desired. The Court said that if there is prejudice in this case, which is far from being established by the employer who has the onus of proof in this regard, it was rectified by the procedures followed by the Umpire.
