The applicant claims that the court violated a principle of natural justice or that the refusal to grant permission to appeal is otherwise unreasonable. The application for judicial review was granted because a grave injustice has been committed by the Court by not returning to the applicant the appeal that he had completed and that was obviously incomplete. Sec. 41(a) of SST Regulations which allows the Appeal Division to ask for additional information before granting or refusing a leave to appeal confers a discretionary power. The wrong form having been submitted... the application for leave to appeal of the decision by the General Division is returned for re-determination by another Member of the Appeal Division.
