Summary:
The issue was whether the claimant was entitled under the collective agreement to a period of leave after leaving the ship on which he was employed. The Court rejected the Commission's application for the following reasons: the problematic record of facts, the absence of the collective agreement or other evidence capable of establishing that the claimant was entitled to a period of leave and given the Umpire's finding that the claimant's casual employment was terminated when he left the ship and did not continue thereafter.
