Summary:

The claimant returned to work on July 6, 2009 after receiving maternity and parental benefits. On July 8, 2009 she made an additional application for benefits under a work-sharing program. The Commission concluded that the claimant was not eligible to receive benefits as her benefit period of 50 weeks could not be extended, the claimant did not return to work before the end of her benefit period. This person did everything that a reasonable person should do in order to protect her right to benefits. She was unable to get through a system which she had no choice but to follow. She was promised a timely answer on three separate occasions. She never received a timely answer. Even the last reply of July 10 was wrong since it stated that the claimant needed to be back to work on June 21, 2009 while the Commission in its submission gives the week of June 28 as the dead line. The appeal by the Commission is dismissed by the Umpire.
