Summary:
An audit revealed that the claimant that salary amounts provided by the employer did not match those declared by the claimant on his claimant's reports. The claimant explained that, being part-time and working interrupted hours, he received a percentage, the amount of which he did not know and could not report. The Commission determined that the claimant had received monies in the form of salary and those monies constituted earnings. Therefore, the Commission allocated those earnings, which created an overpayment of $338.00 but no penalties had been imposed. The claimant appesled from the Commission's decision. He reiterated that it was impossible for him to declare the exact amount because, for the same week, he received three different amounts for the work performed. The BOR unanimously dismissed the appeal. Accordingly, the claimant’s appeal is dismissed by the Umpire.
