Summary:
The claimant had a claim for sickness benefits established on January 27, 2008, the Commission established a new qualifying period from January 27, 2008, to May 31, 2009; during that period, the claimant accumulated only 209 hours of insurable employment, whereas she needed 630 to be entitled to receive benefits. The Commission denied her claim. The Board further erred in law when it decided to extend the benefit period beyond January 27, 2008, since, under subsection 8(1) of the Act, the qualifying period cannot precede the beginning of a previous benefit period. Since a sickness benefit period had already been established as of January 27, 2008, the claimant's qualifying period could not be extended beyond that date. The Commission's appeal is allowed by the Umpire.
