Summary:

Upon receipt of a second speeding ticket which was considered a serious safety violation by the employer, a bus operator faced several options - he chose resignation. The claimant invokes subsection 29(c)(iv) contending that working conditions constituted a danger because of the risk to himself and the public for the reason that he lacked the ability to drive properly. That subsection refers to dangerous working conditions imposed upon a claimant by an employer. It does not refer to dangerous conditions created by the claimant.

Summary:

The claimant argues that he left his employment based upon the option of a mutual separation. That form of separation did not demand that the claimant resign. That was the option he chose. It was a personal decision. He had the choice to stay or to leave and he chose to leave after weighing his options.

Summary:

The claimant invokes subsection 29(c)(xiii) contending that the employer placed undue pressure on him to quit. That contention is not supported by the evidence. The employer intended to recommend dismissal. Following discussion with claimant's union the employer agreed to retain the claimant in its employ subject to options and conditions it presented and the claimant chose the option of resigning. He was not pressured to resign.
