Summary:
Under the Salary Deferral Plan claimant instructed his employer to put part of his salary each month into a trust fund. Upon payment into the fund he became the beneficial owner of the money. He later was granted sabbatical leave. Ss. 10(2) does not apply. [Act amended since]

Summary:
One last matter to consider: part of the Deferred Salary Payment Plan which had not been presented to the Board was added to the file by the Commission. Based on TAYLOR, I do not feel that I am entitled to consider any evidence which was not before the Board.
