Summary:
What should have been determined is whether the claimant regularly worked a greater number of hours than is normal in full-time employment, whether his contract called for a period of time off and whether the former was the reason for the latter.
Assistant cook required to work 12 hours per day while at sea, 7 days a week. When he had completed 2 fishing trips he was entitled, under his contract, to a period of time off work, a period that would be equal in length to the immediately following 2 trips.
