Summary:
As there is another question on the Report Card as to whether one earned money during the period in question, he must be taken to have understood that the question "Did you work" meant literally what it said.
Claimant only thought that the should answer "yes" to "Did you work" if he had made money out of his work. Such an explanation cannot be taken seriously, particularly by someone intelligent and literate enough to operate the kind of business in which hewas engaged.

Summary:
Counsel assumed that as claimant was earning no money from his business he would be entitled to UI and it was irrelevant whether he worked or not. That is clearly not the case. A claimant who is working is not unemployed, and a person who is not unemployed is not entitled to UI.
