Summary:
The Umpire had found that the Commission was no longer contesting the issue of the claimant's justification for leaving his employment. In support of its application, the Commission filed an affidavit of the counsel who represented the Commission before the Umpire. The counsel's affidavit stated that she never advised the Umpire that the Commission was abandoning its position regarding the issue of the claimant's justification for leaving his employment. On the basis of the affidavit, the FCA decided that the Umpire erred in concluding that the Commission has abandoned its position with repect to the issue in question.
