Summary:
While the claimant was receiving regular benefits, he said that he was not available from March 25 to 31, 2007, and from April 15 to 21, 2007, because he was sick. As a result, he received sickness benefits for these two weeks. In April 2008, the claimant asked that these two weeks be converted to weeks of regular benefits on the grounds that he was not sick. The claimant challenged the Commission’s policy not to require a medical certificate in all cases. The FCA concluded that subsection 50(10) of the Act confers that discretion to the Commission not to require a medical certificate. The application for judicial review is dismissed.
