Summary:

Is the Commission entitled find that a work-sharing agreement is null and void if the employer and the employees never intended to abide by the terms of the agreement? BOR and Umpire found that the Commission did not have this power. FCA said they erred. If there was no intention to abide by the terms of the agreement, the consequence is that the agreement never existed. Provided that the time periods prescribed in s. 43 or 86 of the EI Act are observed, the claimant must meet the other requirements of the Act to be eligible for benefits.
