Summary:
The claimant stated that his wife had used his Teledec code to file his reports without his knowledge. The judge found it difficult to accept that the claimant would not have known that deposits of this magnitude would have been made in his joint account and used without his knowledge, unless he was totally negligent in regard to his personal finances. He confirmed the Board's findings that the claimant is liable for the repayment of those benefits in accordance with sections 43 and 44 of the EI Act.

The claimant knowingly gave his personal and confidential telephone access code to his spouse who did not report his earnings correctly. Summary:
Benefits were paid without the claimant's knowledge on the basis of cards fraudulently submitted by his ex-spouse, and cheques were cashed by the claimant's ex-spouse, again without his knowledge. The FCA ruled that there could be no overpayment in the claimant's name because the claimant had never alleged that he was entitled to benefits, had not failed to report the earnings received and had not received the benefits.
