For the purposes of these proceedings, the determination of the Minister of National Revenue that the employment was insurable must be taken as final. Case returned to Umpire to decide what was the amount of insurable earnings and the period over which it should be allocated.

Summary:

As to the quantum of earnings, we would observe that the provisions of the UI (Collection of Premiums) Regulations as they relate to "commissions paid...on the basis of a pay period" appear singularly inapt to describe a commission received in respect of a single transaction. Real estate salesman whose employment may or may not be insurable depending on his amount of earnings. Case to be returned to Umpire to decide what was the amount of insurable earnings as a real estate agent and should that amount be allocated to the entire 18 weeks or to one day.
