Summary:

The claimant applied for compassionate care benefits as of July 23, 2006 to care for his father. He provided two death certificates indicating that his father passed away on March 13, 2008. The Commission refused to pay compassionate care benefits as of July 31, 2006 because the claimant failed to provide a medical certificate indicating that his father had a significant risk of death within the next 26 weeks and that the patient required the care or support of one or more family members. The claimant says that the doctors in Russia do not provide such types of certificates. It was suggested to the claimant that he should forward a translated copy of Section 23.1 of the Act to the doctor or hospital in Russia who treated his father and see if its still possible to obtain a medical certificate retroactively and valid under our Law. The claimant’s appeal is dismissed.
