Summary:
All parties thought that the approved SUB plan covered parental leave. The Commission found out later, at a time when it was too late for the employer to amend the plan (in line with its primary purpose) to benefit the claimant, that it was not the case. Retroactive ruling.

Summary:
The Board, like the Umpire, is obliged to apply the Act and regulations made under the Act. The Board, once again like the Umpire, has no mandate or discretion to do what might be seen to be "fair" or "just" unless, in so doing, it is applying the law to the fact situation before it.
