Summary:
I can hardly accept the argument that an attorney is not available because of a heavy schedule; this does not constitute a valid reason to set aside the order of a judge to the effect that an appeal must be heard in a peremptory manner. The notice had been issued several weeks ago.

Summary:
The insured was prepared to waive the legal requirement so that the dispute can be heard. I doubt that this commitment could be construed as likely to have any legal follow-up. Legislation cannot be amended by an umpire to extend a default. Such action would be outside my jurisdiction.
