Summary:
Commission's decision overturned by FC. Claimant's name not in the list of cases. I doubt this can be dealt with under s.86. No fact is new, nor has anyone made any mistake as to a material fact. It would be stretching the meaning of new fact to includean issue of law.

Summary:
It is in the interests of the good and proper administration of justice for group claims to be made. Conformity in the application of the law is a valid goal to achieve. What better way than by group claims, avoiding thereby the kind of ludicrous situation facing the tribunal.

Summary:
Commission's decision overturned by FC. Claimant's name not in the list of cases by reason of inadvertance. He was part of the group, although he might not necessarily have been aware of it at the time. The fact he was running through parallel proceedings is not material.
