Issue: Sub-Issue 1: Sub-Issue 2: Sub-Issue 3:
week of unemployment  work without earnings

Summary:

Laid off but continued to perform work as manager without pay. Contrary to ST-PIERRE, not working the same amount as before. His allegation that his first and main objective during time spent at the office was to seek work is borne out by extensive job list.

Issue: Sub-Issue 1: Sub-Issue 2: Sub-Issue 3:
week of unemployment  applicability

Summary:

The claimant is correct when he argues he cannot be disentitled under ss.21(1) and reg. 44(1). It should have been under s.19 as he was not unemployed, rather than he was disentitled.

Issue: Sub-Issue 1: Sub-Issue 2: Sub-Issue 3:
umpires  jurisdiction  question not at issue

Summary:

The Commission suggests that it could be argued that reg. 43 applies instead of 44. This however is irrelevant because this appeal is not a trial de novo.
