He held that Canadian immigration had sent him back to the United States due to external circumstances beyond his control and that he did not leave Canada of his own accord. He was not re-admitted to Canada until June 8, 2009. The Commission determined that it could not extend the claimant's qualifying period because his situation did not meet the conditions under which an extension is allowed. He argued that if the Act could extend the qualifying period for an inmate who has committed a crime, it could not deny the same to an exile. The claimant's appeal is dismissed by the Umpire.
