The claimant had apparently gone to Kentucky where she had attended University and played golf. The claimant was visiting Kentucky for a short time in November, 2005 to visit friends and went there again in December of 2005 and continued to stay there until the 5th of January to celebrate New Year's, and then late January went to Kentucky to attend a wedding. As she was a professional golfer, she went there with the intent of exploring possible work opportunities for the future. The claimant did not prove that she was outside of Canada at any golf interview, to conduct a bona fide job search or that she had appointments in respect of her profession within the meaning of the legislation. Appeal is dismissed.

The Commission issued a notice of disentitlement pursuant to ss. 9 and 11 of the Act and s. 30 of the Regulations to the Act for failing to prove he was unemployed. The claimant established a claim effective April 26, 2009. He had last worked as a part-time teacher from January 13, 2006 to April 24, 2009. He advised the Commission that she started to work on a contract basis. A copy of his contract clearly states “Contrat entrepreneur”, the claimant was an entrepreneur working out of his home four to six hours per day at $24.00 and was working without supervision or control from the school. He advised he was a self-employed as an English teacher and that his remuneration was sufficient for his need and that he was not seeking employment. The appeal by the claimant is dismissed.

The claimant failed to prove he was unemployed and available for work: availability under S. 18 of the ACT. The BOR also finds as fact that although the claimant states that he did not help in setting up the business, nor help with the cleaning and the painting during business hours Monday to Friday we do not finds this credible. Also, that it is not reasonable to invest such a huge amount of money into a business, and then rely on someone else to oversee the business, while the claimant would continue to look for work. The Board finds as fact that the claimant was spending time and energy setting up his business to be self employed and this was his main intention. The BOR also finds that the claimant conducted a minimal job search. The Umpire confirms the BOR decision and the appeal of the claimant is dismissed.
